Rental Agreement
The following disclosures are to help you understand the Terms and Conditions of your Rental Purchase Agreement.

I acknowledge receipt of the instrument listed herein. I further understand and agree to rent from Pecknel Music Company the aforementioned instrument according to the terms and conditions listed below:
Return Option
I understand that I have the right to return this instrument at any time and the Agreement will be terminated with no further obligation, provided the instrument with all standard parts and components (mouthpieces, stands, bows, sticks, straps, etc.) is delivered to the business premises of Pecknel Music Company, one of its affiliates, or to an official Company representative; in good condition, reasonable wear and tear excepted, and provided monthly payments are current. A dated return receipt must be secured at that time and retained as proof of return. I understand I will be financially responsible for any rental charges owed up until the time the instrument is returned, including any charges past due, any missing parts or components, and any damage resulting from willful neglect or careless treatment, vandalism, or unauthorized repairs. A minimum of $25.00 will be charged to my account for any missing parts or components not returned to us. Please note that any change in Electronic Funds Transfer require 10 days’ notice. Pay It Off and Save!
I understand that, at any time after the first scheduled monthly payment is made, I may acquire ownership of this instrument by paying fifty-five percent (55%) of the balance of this Agreement, which is the difference between the Total of Scheduled Payments and the total amount paid to the account. The Total of Scheduled Payments includes applicable sales tax but does not include any delinquency charges or monies paid for M&R Coverage. Ownership
I understand that I will not own the instrument until I have made the number of payments and the Total of Scheduled Payments necessary to acquire ownership of this instrument. I understand and agree that I do not have the right to sell, pawn, assign, transfer, sublease, remove from the state, or encumber this instrument, or in any way dispose of this instrument during the term of this Agreement.
Default/Right to Cure/Repossession
I understand that, in any event of my breach of any term or condition of this Agreement, Pecknel Music Company may assume that I do not wish to continue the Agreement and may terminate the Agreement. Pecknel Music will then be entitled to any remedies allowed by law. Pecknel Music will first provide to me a “Notice of Default, Right to Cure, and Intent to Repossess”. If I do not comply and do not pay the Total Amount Due by the cure date as prescribed on this Notice, Pecknel Music has the right to repossess the instrument wherever found, at school or elsewhere. Once I surrender the instrument, I understand that I will be able to reinstate the Agreement by paying the outstanding balance of any accrued payments and delinquency charges allowed by law.
Late Payments
If a monthly rental payment is declined, Pecknel Music Co. will continue attempting to draft the payment until the funds are collected. If your monthly rental payment is not made as scheduled, you expressly agree to allow us or our agents, including debt collectors, to contact you via telephone, text message, or email at any number or email address you provide us even if you are charged for the service. I understand and agree that Pecknel Music may collect, and I shall pay, as allowed by the SC Code of Law, Section 37-1-109, a delinquency charge of $8.00 per month for any monthly rental payment not made within five days after it becomes due.
Maintenance & Repair Coverage (M&R)
The purchase of M&R Coverage is voluntary, and paid monthly, due on the monthly payment date and applying to the current month only. Coverage includes routine maintenance and repair of normal wear and tear and accidental damage necessary to keep the instrument in proper playing condition. Repairs must be performed by a Pecknel Music Repair Technician. Delivery and pick up of instruments to/from our shops for repairs under this Coverage must be made at customer’s expense. Coverage does not include damage resulting from willful neglect or careless treatment, vandalism, unauthorized repairs, restoration of finish, general cleaning, polishing, chemical/ultrasonic cleaning, case repairs, cosmetic dents or scratches that do not affect the playing condition, replacement of lost parts or expendable accessories such as mouthpieces, reeds, straps, lubricants, drum heads, drum sticks, strings, bows, bow hair, etc. Monthly payments must be current for the M&R Coverage to be in effect. All shipping costs must be prepaid by the customer. Renewal of this plan is optional and may be offered on an annual basis after this Agreement terminates. I understand that, should I decline this coverage, and should I return the instrument to Pecknel Music at any time, I will be financially responsible for the repair of all damage to the instrument beyond reasonable wear and tear.
Student Instrument Replacement Plan (IRP)
The purchase of IRP Coverage is voluntary, and paid monthly, due on the monthly payment date and applying to the current month only. Coverage applies to student instruments only and provides for replacement of the instrument with one of comparable age and condition if the instrument is lost through fire or theft, or irreparably damaged. This replacement provision covers only the instrument, case, and standard accessories and DOES NOT cover personal items. Notification of loss must be made to the police or sheriff's office and a copy of the report given to Pecknel Music within ten (10) days of the occurrence, or this replacement guarantee will be void. Monthly payments must be current for the IRP Coverage to be in effect. Renewal of this plan is optional and may be offered on an annual basis after this Agreement terminates. I understand that should I decline this coverage; I will be financially responsible for the full value of the instrument should it be lost or damaged beyond repair for the entire term of this Agreement.
Exchange Option
I understand that, with teacher recommendation and approval, I may exchange the instrument listed on this Agreement for any other type of Beginner Band or Orchestra Instrument within 6 months of the initial date of this Agreement. All rental payments made (excluding late payments, M&R and IRP fees) will apply towards the exchanged-to instrument, and the prevailing monthly rate of the exchanged-to instrument will apply.
Changes in this Agreement
I understand and agree that, should any errors be made in properly filling out this Agreement, Pecknel Music will correct the errors and notify me of such changes, and I will be bound to them. I also agree to inform Pecknel Music of any changes in my name, address, phone number and/or any other contact information within ten (10) days after these changes occur. Privacy Statement
Pecknel Music Company understands your privacy is important. You have received this notice in accordance with applicable state and federal laws. This statement will inform you what information we collect and explain our practices to protect your personal information. The provisions of this notice will apply to former customers as well as current customers. Our Policies and Practices to Protect Your Personal Information: • We restrict access to non-public personal information to those employees who need to know the information to perform their jobs. We have policies and procedures in place to protect personal information about our customers. • We do not share non-public information with non-affiliated third parties; e.g., companies or individuals not affiliated with Pecknel Music Company. • We maintain physical, electronic and procedural safeguards to protect your non-public personal information. Personal Information We Collect: • Identification information we receive from you on applications or other forms such as name, address, social security number, driver’s license number, bank and credit card information. • Information we receive from a consumer reporting agency, such as your credit bureau reports and other information relating to your creditworthiness. • Information about your transactions with us, such as account balances, payment history, and account activity. This notice applies to all locations of Pecknel Music Company.
Lease Agreement

Payment of Rent
Pecknel Music Company hereby acknowledges receipt of payment of the rent due for the original term of this lease. The rent of each extension shall be paid in advance, within seven days after the termination of the previous period. If a monthly rental payment is declined, Pecknel Music Co. will continue attempting to draft the payment until the funds are collected. If your monthly rental payment is not made as scheduled, you expressly agree to allow us or our agents, including debt collectors, to contact you via telephone, text message, or email at any number or email address you provide us even if you are charged for the service. I understand and agree that Pecknel Music may collect, and I shall pay, as allowed by the SC Code of Law, Section 37-1-109, a delinquency charge of $8.00 per month for any monthly rental payment not made within five days after it becomes due.
Renewal
For as long as the child requires a smaller than full size instrument, this lease may be renewed. As the child grows into a larger size instrument, the proper size will be supplied. When the child grows to a full-size instrument (4/4 violin or cello, 15” or larger viola, or ¾ string bass), 60% of all lease payments made up to that time will be credited to the purchase of a full-size instrument (or a 35% discount taken, whichever is greater).
Return Privilege
I understand that I have the right to return this instrument at any time and the Agreement will be terminated with no further obligation, provided the instrument with all standard parts and components (mouthpieces, stands, bows, sticks, straps, etc.) is delivered to the business premises of Pecknel Music Company, one of its affiliates, or to an official Company representative; in good condition, reasonable wear and tear excepted, and provided monthly payments are current. A dated return receipt must be secured at that time and retained as proof of return. I understand I will be financially responsible for any rental charges owed up until the time the instrument is returned, including any charges past due, any missing parts or components, and any damage resulting from willful neglect or careless treatment, vandalism, or unauthorized repairs. A minimum of $25.00 will be charges to my account for any missing parts or components not returned to us. Lease fees paid up until the time the instrument is returned are not refundable under any circumstances. Please note that any change in Electronic Funds Transfer require 10 days’ notice. Location of Property and User
I agree to keep this instrument at the address given, and agree that only the student named herein, who resides with me, shall use this instrument. I understand and agree that I do not have the right to sell, pawn, assign, transfer, sublease, remove from the state, or encumber this instrument, or in any way dispose of this instrument during the term of this Agreement.
Default
I understand that if I default in the payment of any installment of rent or lease, or if I do not keep this instrument at the address given, or if I do not allow Pecknel Music Company to examine this instrument at any time, or if Pecknel Music Company otherwise determines that repossession of this instrument and termination of this lease is desirable to protect its interest, Pecknel Music Company may, at its option without notice, terminate this lease by taking possession of the instrument wherever found or by mailing written notice of such termination to me. I understand that if I do not return this instrument within five (5) days after this notice is mailed, I will pay Pecknel Music Company $2.00 each day that elapses thereafter until the instrument is returned to Pecknel Music Company. I understand that repossession of this instrument or termination of this lease by Pecknel Music Company does not constitute a waiver of Pecknel Music Company’s right to collect all delinquent installments of rent, damages for any injury of this instrument, and any other amount owed to Pecknel Music Company pursuant to this lease. I agree to pay all legal fees and other expenses incurred by Pecknel Music Company in connection with the repossession of this instrument and the collection of any monies owed Pecknel Music Company pursuant to this lease. I understand that remedies are cumulative, and no delay or omission of Pecknel Music Company to exercise any right arising from any default shall impair any such right or be construed to be a waiver of any such default.

Renewal of this plan is optional and may be offered on an annual basis after this Agreement terminates. I understand that, should I decline this coverage, and should I return the instrument to Pecknel Music at any time, I will be financially responsible for the repair of all damage to the instrument beyond reasonable wear and tear.
